Our Terms of Service

TAIM AFRICA USER Agreement: Last Updated: August 9, 2023

 

The web site located at http://taimafricaarts.org (the "Site") is provided by TAIM AFRICA ARTS LTD, a representation organization in Uganda (East Africa), and contains information which may be of interest to entertainment industry professionals about movies, television and the entertainment industry from TAIM AFRICA and third parties. Your access to and use of the Site is governed by this Agreement ("Agreement").

 

In this Agreement, "TAIM AFRICA," “TAIM,” "our," "us" or "we" refers to TAIM AFRICA ARTS LTD, and "you" or “your" refers to you, the user of the Site.

 

The Agreement below is the agreement you consented to upon creating an account on this Site. 

 

1. Accounts and Passwords

For account creation on this Site, you have selected a particular password and been assigned a user ID in accordance with TAIM AFRICA's password and TAIM AFRICA ID guidelines. You consent that you are the sole individual with access to the Site using your password or user IDas you also agree not to allow anyone else apart from yourself to access your password or user ID. Visit http://www.taimafricaarts.org/register/forgotten to obtain a new password in case you lose your password.

2. Access and Subscriptions

Many of the tools and features on this Site are free, whereas others require a monthly subscription fee between $5 to $10.

Free items include; regular account creation, upgrading to a filmography account, uploading personal information, biography and media content, creating a profile page for your film content, creating a profile page for your company/organization, and other suggested free items by TAIM AFRICA.

Items that require monthly subscription fees include; creating personal blog posts, creating company blog posts, creating event announcements and sell of event tickets, chatting/messaging, and other suggested subscribable items by TAIM AFRICA. You can choose to permit automatic deduction of subscription fees from your account or choose to pay subscription fees manually.

3. Payments

The Site has some payable items like the creation of a job announcement, creation of an advert, buying of extra storage space for your media files, and other suggested payable features by TAIM AFRICA. Payments for these items are billed to the credit card designated by you or from your TAIM AFRICA digital wallet.

4. Payment Methods

Only three methods are accepted for conducting of payments by this Site. The methods include; credit card/bank, mobile money and Taim Wallet. All payments and subscriptions required by the Site will be billed from the payment methods listed above. 

5. Copyright 

Content availed on this Site is not and shall never be a property of TAIM AFRICA unless legal content licensing processes have been taken, with a licensing agreement signed between the content owner and TAIM AFRICA ARTS LTD.

Users have a free-will to upload content that is acceptable by TAIM AFRICA for free public access including; personal biography, movie or series promotional content like trailers, posters, cast and crew profiles and other items but not film screenplays/scrips or full film videos/episodes.

Material on this Site is uploaded and posted by Users and acts like altering, republishing, framing, linking or filtering of this material from this Site is highly prohibited.

If you suspect or believe that your material/content has been copied or used in any way that constitutes copyright infringement, please write to our support team at support@taimafricaarts.org

6. User Conduct

Different profiling and communication facilities are designed by the Site to enable you achieve your interests, but you will have to use them with care. You agree to use communication services to only submit and post content/material that is proper and related to specifically the film industry.

You are prohibited from posting harmful, unlawful, threatening, harassing, vulgar, abusive, profane, defamatory, obscene, racially, sexually explicit, ethnically, hateful or any kind of objectable material/content that may encourage conduct that would constitute criminal offence or violence. Spam content is prohibited and may cause a permanent ban of your account and future accounts.

You agree that you are responsible for all activities done or undertaken during the use of this Site's communication services, and you will not make any false, inaccurate or misleading content.

TAIM AFRICA reserves the right in its sole discretion to reject information that may look copied, remove or modify information on the Site. TAIM AFRICA does not assume any obligation to do so and to the extent permitted by law.

If TAIM AFRICA terminates/bans your account, all information including your resume data and any information saved in connection with your use of this Site will be deleted.

7. Content Submissions

All content posted on this Site will be submitted for reviewing before being approved for public display. This process covers all content/information not limited to your profile information, demo reels, photos, videos, comments, reviews, film titles and other content you may create on this Site.

You agree that you own all rights to all the content/information that you post on this site. You also agree that the content will not cause any harm to any person, the content is accurate, and does not violate TAIM AFRICA's submission guidelines.

No submission is subject to any obligation or confidentiality or limited to use by TAIM AFRICA.

8. Privacy

Carefulness is our guarantee to you when it comes to using or sharing your information.

Information You Give Us

Here is some of the compulsory information we collect from you for effective use of all services on this Site;

  1. Your name, phone number, email address, physical address
  2. Your gender
  3. Your age
  4. Your IP address
  5. Your Payments information (credit card or mobile money number)
  6. Images and Videos uploaded by you
  7. Your physical attributes
  8. Personal description and photographs uploaded by yourself
  9. Identity documents (National ID, Driver's Licence and Passport details)

Other types of information are collected during the use of the site. We use your personal information to develop, operate, improve and provide the most fit products and services for your account.

You may choose not to provide some information, but this limits your ability to access some services on the Site. We always safely receive and store your information. If you have any concern about privacy at TAIM AFRICA, please reach us with a thorough description on support@taimafricaarts.org

9. Information Accuracy

TAIM AFRICA uses maximum commercial professionalism to ensure the accuracy of information on this Site, but we give no warrantee that to the accuracy of all information on this Site. Any approach taken by you to use the information on this Site or rely on such information when making decisions will be considered done at your own risk. TAIM AFRICA reserves the right to withdraw or delete information, material or content that might seem unfit for service standards on this Site at any time.

10. Messaging/Chatting

The messaging service is only provided to filmography accounts. Regular user accounts will on be able to receive and respond to messages but not to start conversations. This is done for privacy enhancement purposes. You are solely responsible for all actions done when using the messaging/chatting tools on this Site.

11. TAIM Digital Wallet

The digital wallet provided on this Site is for specifically monetization purposes. The wallet collects and carries information about the entertainment industry, most specifically the film industry. You are allowed to deposit money on your wallet for execution of tasks, payment of Site services, building creditworthy for support funds from TAIM AFRICA ARTS LTD, and for investing in the entertainment industry.

Money deposited on your digital wallet will always and forever be used for the above-mentioned reasons and shall not be withdrawable to cash form. The only option for converting your deposited money on the Site's digital wallet to cash form is to send or share your deposited money to another digital wallet holder with personal agreements of the other digital wallet holder giving you cash in exchange of your shared deposited money. TAIM AFRICA is and shall not at anytime be attached or responsible in any process of personal Site user agreements.

12. Filmmakers Circle

The Site has a special membership based group for only users with filmography accounts, labelled the "FILMMAKERS CIRCLE." This is a union portal for interested film practitioners from different parts of the world to communicate through group blogs/posts, responses and reactions. The group is provided to strengthen communication amongst film practitioners. TAIM AFRICA is not responsible for any activity made or done within this group but we try as much as possible to ensure group member privacy and security.

13. Representations and Declarations

You represent and declare to TAIM AFRICA that you own the legal rights to enter into agreements with TAIM AFRICA ARTS LTD through the user account you are possessing on this Site. You warrantee that all communications you are making or the information you are submitting on this Site is true and accurate. You are solely responsible for the use of your account user ID and user Password even in the event that such use was conducted without your authority or permission. You confirm that you are of an age not younger than 16 years, and you will not conduct unlawful or prohibited acts on this Site.

14. Limitation of Damages

In no event will TAIM AFRICA or its affiliates be liable for any consequential, indirect, incidental or special damages whatsoever, including without limitation damages for unauthorised access to information, loss of profits, bleach of contract, and the like - even if TAIM AFRICA has been informed and advised of the possibility of such damage.

15. TIP (TAIM Integrated Points) - Wallet Currency

At no point and in no event will TAIM AFRICA be liable to you for any amount in excess of the dollar amount actually received by TAIM AFRICA from you for access of the services available on this Site. TIP value to dollar may change from time to time but the extended values will have to be covered by you.

16. Indemnity

You indemnify and hold us harmless if we become liable or incur any damages in connection with your bleach of this Agreement. You will not settle any dispute without our prior consent, which may only be given in a non-electronic writing signed by authorized representatives of TAIM AFRICA ARTS LTD.

17. Electronic Notices Consent

You consent that all transactions and communications relating to this Site will be conducted electronically, including any that we are otherwise required to provide in writing. If you feel uncomfortable with electronic communications, you should not enter into this Agreement as we may not serve you to your best expectation. We may communicate with you via email or certified mail postage to the address provided during Site membership registration.

18. Termination

TAIMAFRICA may terminate your membership or suspend your access to all or part of the Site without notice if your conduct happens to be believed or interpreted violating this Agreement. If your membership gets terminated, all your account information may be deleted.

19. Assignment

You will not assign your rights under this Agreement without the consent of an authorized representative of TAIM AFRICA in a non-electronic record. This agreement will bind the parties' respective successors and permitted assigns.

20. Applicable law

This Agreement will be governed by the law of the Republic of Uganda without regard of principles of conflict of laws. Any disputes or claims relating to the use of this Site will be resolved by binding arbitration, rather than in court, except that you may have claims that qualify court.

21. Amendments

If TAIM AFRICA changes its terms of this Agreement, TAIM AFRICA will send you a notice by e-mail or online postings on this Site. The changes will also appear on this same online page, and if you bound not to agree with the changes, you should stop using this Site.

22. Entire Agreement

This Agreement is the entire agreement between the parties for its subject matter and supersedes all prior and contemporaneous communications between the parties. No term of this Agreement may be waivered by TAIM AFRICA except in a signed non-electronic writing signed by an authorized representative of TAIM AFRICA.

23. SEVERABILITY

If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties agree that its remaining provisions will remain in full force and effect, provided that the allocation of risks described herein is given effect to the fullest extent possible. Our failure to act with respect to a breach by you or others does not waive our right to act with respect to subsequent or similar breaches. You agree that no joint venture, partnership, employment or agency relationship exists between you and TAIM AFRICA or its affiliates as a result of this Agreement or your use of the Site. Whenever used in this Agreement, unless otherwise specified, the terms: “includes”, “including”, “e.g.”, “for example”, “such as” and other similar terms are deemed to include the term “without limitation” immediately thereafter.

The software is provided "as is", without warranty of any kind, express or implied, including but not limited to the warranties of the merchantability, fitness for a particular purpose and noninfringement. In no event shall the author or copyright holders be liable for any claim, damages, or other liability, whether in an action of contract, tort or otherwise, arising from, out of, or in connection with the software or the use of other dealings in the software.
