Our Terms of Service

TAIM AFRICA USER Agreement: Last Updated: June 06, 2025

 

TAIM AFRICA ARTS LTD ("TAIM AFRICA", "we", "us") operates and offers services at taimafricaarts.org. Your use of our site, content, and digital services - including filtering and accessing profiles, series, films, managing wallets, wallet points (TIP), SAVI Circle, crowdfunding, Voice Game, Monologue Vault, education guardianship, and more - is governed by these Terms (“Terms”). By accessing or using the site, you agree to be bound by these Terms. If you disagree, please do not use our services.

 

1. Accounts, Passwords & Eligibility

  • You must be at least 16 years old; if under 18, guardian consent is required.

  • You are responsible for all actions under your account, and must protect your credentials. Notify us immediately of unauthorized access.

  • You may hold multiple accounts only if each reflects a different verified identity or membership tier (e.g., Film Practitioner, Friends, Partner). Falsifying information may lead to termination.

2. Membership Tiers & Subscriptions

We offer three membership categories:

 

a. Film Practitioner (Free, Approval Required)

  • For verified industry professionals. Approval is granted upon review of submitted proof (e.g., film credits, trailers, BTS).

  • Includes exclusive tools: profiles, distribution, crowdfunding, loans, content publishing, representation.

  • Manual review by Membership Department. Misrepresentation or inactivity (>12 months) may lead to suspension or termination.

b. Friends of Film (Paid Subscription via TIP Scale)

  • For film supporters, students, fans.

  • Benefits include early content access, behind-the-scenes content, voting, badges.

  • Monthly or annual subscription auto-renewed via loaded TIP balance.

c. Partner of Film (Paid Subscription via TIP Scale)

  • For sponsors, investors, organizations.

  • Includes branding, co-sponsorship, early pipelines access.

  • Monthly or annual subscription via TIP, also auto-renewed.

3. Content & User-Generated Submissions

  • You retain ownership of content you upload (e.g., profiles, trailers, blogs).

  • You grant TAIM AFRICA a non-exclusive, worldwide license to host, display, distribute, and archive your content.

  • You affirm all submissions are accurate, lawful, and non-infringing.

  • We reserve the right to review, approve, modify, or remove content at our discretion.

4. Acceptable Use Policy

Users must not:

  • Post illegal, defamatory, harassing, abusive, or discriminatory material

  • Upload malware or spam

  • Impersonate others

  • Use for non-film industries or unrelated content

  • Violate intellectual property rights
    Violations may result in suspension, termination, or legal action.

5. Wallet, TIP, and Payments

  • TAIM AFRICA Wallet and TIP (TAIM Integrated Points) manage all transactions.

  • TIP are digital credits earned or purchased. Use them for subscriptions, campaigns, loans, investments, etc.

  • TIP may not be redeemed for cash. Money maintained in wallet/TIP is non-withdrawable except via P2P transfers to other users.

  • Subscription auto-renewal requires sufficient TIP balance. Non-payment leads to access suspension.

  • No refunds for unused portions of paid periods.

6. Crowdfunding & Loans

  • Film Practitioner members can start crowdfunding campaigns and apply for project loans via our platforms.

  • Campaigns and loan terms are subject to separate guidelines and agreements, which you must accept when launching or applying.

7. Feature Rules: SAVI Circle, Investment Points, Voice Game, Monologue Vault

  • Each program has its own eligibility, participation, and award/payout rules. You must follow published guidelines.

  • Misuse or fraud in participation may result in disqualification and reputation impact.

8. Intellectual Property & Brand Usage

  • All TAIM AFRICA trademarks, logos, and proprietary content are protected by law.

  • You may not use them outside authorized platform areas without written permission.

  • Unauthorized brand use may lead to legal action.

9. Disclaimer & Limitation of Liability

  • The site and all content are provided “as-is” without warranty of any kind.

  • We do not guarantee access, performance, or accuracy.

  • To the full extent permitted by law, TAIM AFRICA disclaims all liability for indirect, consequential, or incidental damages resulting from use or inability to use the site.

10. Third-Party Services

  • We may provide links or embed content from third-party providers (e.g., payment processors, crowdfunding platforms).

  • Those services are governed by separate terms that you must review. TAIM AFRICA is not responsible for third-party actions or content.

11. Privacy & Data

  • Our [Privacy Policy] describes how we collect, use, and protect your data.

  • Using the site acknowledges you have read this policy.

  • For GDPR compliance or other regulations, you may have additional rights.

12. Termination & Inactivity

  • We may suspend or terminate accounts that violate these Terms, engage in illegal or harmful conduct, or are inactive for 12 months.

  • Upon termination, your data and content may be deleted unless we legally must retain it.

  • You can delete your account at any time by contacting support.

13. Changes to the Terms

  • We may update these Terms occasionally.

  • Notifications will be made via email and on-site messages.

  • Continued use after any change means you accept the updated Terms. If you disagree, you must stop using the site or request account closure.

14. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Uganda.

  • Any dispute will first be resolved informally and, if unresolved, via binding arbitration in Uganda, except for small claims which may proceed in court.

15. Severability & Entire Agreement

  • If any section is found unenforceable, the rest remain in full force.

  • These Terms constitute the entire agreement and supersede prior agreements.
